Abuja Court Throws Out Aisha Binani’s Case Against INEC

Justice Inyang Ekwo of the Federal High Court in Abuja has on Wednesday, thrown out a suit filed by Senator Aisha Binani against the Independent National Electoral Commission (INEC).

Counsel for Binani, Mohammed Sheriff, had called for the discontinuance of the suit and asked for the court to strike it out.

Binani who is the governorship candidate of the All Progressives Congress (APC) in the recently concluded gubernatorial election in Adamawa State, had initially filed the suit seeking to prevent INEC from taking any further steps against the declaration of her as the winner of the election by the Adamawa Resident Electoral Officer (REC).

Recall that the REC, Hudu Yunusa, had illegally declared Binani as the winner of the election and she had gone ahead to issue a statement accepting the declaration.

However, INEC declared the announcement as null and void and subsequently recalled Hudu Yunusa, before doing a fresh collation which returned Ahmadu Fintiri of the Peoples Democratic Party as the winner and Governor-Elect.

Binani had headed to the court to prevent INEC or its agents from taking any steps against her declaration as winner. She had argued that INEC could not nullify the declaration as only a court order as such would be lawful.

The court initially refused to hear the suit and asked for an address on the jurisdiction of the court before the motion could be heard. The case was subsequently adjourned for hearing today April 26th, which resulted in the final dismissal of the case after the filing for dismissal by Binani.
